ToolsForUse Terms and Conditions

1. Definitions

• Platform: the ToolsForUse mobile application and related services.
• User: any person who downloads, registers, or interacts with the Platform.
• Owner: a User who lists a tool for rent.
• Renter: a User who rents a tool from an Owner.
• Listing: a tool posted for rent on the Platform.
• Rental Agreement: the agreement formed directly between an Owner and a Renter.

2. Platform Role

ToolsForUse is a technology platform that facilitates connections between tool owners and renters.

All rental agreements exist solely between the Owner and the Renter. By confirming a rental, Users acknowledge that they enter into a binding agreement with each other and not with ToolsForUse.

• ToolsForUse does not own, rent, lease, or sell tools listed on the Platform.
• ToolsForUse does not inspect or guarantee the safety or condition of any tools.
• ToolsForUse is not a party to any rental agreement between Users.

3. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform you confirm that:

• You are legally able to enter into agreements.
• The information you provide is accurate.
• Your use of the Platform complies with applicable laws.

4. User Accounts

Users may be required to create an account. Users agree to:

6. Rental Terms Between Users

Owners may define additional rental rules, including:

• Security deposits.
• Late return penalties.
• Condition requirements.

7. Payments

Payments are processed through third-party payment providers. ToolsForUse does not store payment card information. Users agree that third-party payment providers may process transactions according to their own terms.

8. Security Deposits

Owners may require a security deposit. Deposits may be held during the rental period and may be used to cover:

Disputes should first be resolved directly between the Owner and the Renter. ToolsForUse may provide tools to assist dispute resolution but:

11. Taxes and Legal Compliance

12. Prohibited Activities

Users agree not to:

• Bypass payments outside the Platform.
• Upload malicious software.

13. User Verification

14. Limitation of Liability

ToolsForUse provides only a platform to connect Users. ToolsForUse is not responsible for:

• Damages resulting from rentals.
• User behavior or disputes.
• Losses arising from the use of the Platform.

15. Account Suspension or Termination

ToolsForUse may suspend or terminate accounts that:

• Repeatedly cause disputes.
• Attempt to circumvent platform payments.

16. Privacy

User data is collected and processed according to the ToolsForUse Privacy Policy. By using the Platform you consent to such processing.

17. Modifications to Terms

ToolsForUse may modify these Terms periodically. Continued use of the Platform after updates constitutes acceptance of revised Terms.

18. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, unless otherwise required by applicable consumer protection laws.

19. Arbitration

To the extent permitted by law, disputes arising from use of the Platform shall be resolved through binding arbitration, except where prohibited by law. Users waive participation in class-action lawsuits.

20. Indemnification

Users agree to indemnify and hold harmless ToolsForUse, its owners, employees, and partners from any claims, damages, liabilities, or legal expenses arising from:

• Misuse of the Platform.
• Violations of these Terms.
• Disputes between Users.
• Violation of applicable laws.

21. Force Majeure

ToolsForUse shall not be liable for service disruptions caused by events beyond its control, including:

• Natural disasters.
• Internet outages.
• Cyberattacks.
• Government actions.
• Failures of third-party services.

22. Off-Platform Transactions

Users agree that all rentals initiated through the ToolsForUse Platform must be completed through the Platform's payment system. Users must not:

• Redirect other Users to external services or websites to avoid platform fees.
• Cancellation of the transaction.
• Suspension or permanent termination of the User account.
• Removal of Listings.
